Introduction​

Thank you for using Altair and/or Overseer ("the Bot").
By using the Bot, you agree to comply with and be bound by the following terms and conditions.
Please review these terms carefully.
If you do not agree to these terms, you should not use the Bot.

Usage of the Bot​

  1. Eligibility: By using the Bot, you confirm that you are at least 13 years old and have the necessary legal capacity to enter into these terms. If you are under 13, you must have your parent or guardian’s permission to use the Bot.
  2. Compliance with Discord's Terms: You agree to comply with Discord's Terms of Service and Community Guidelines while using the Bot. Any violation of these terms may result in the suspension or termination of your access to the Bot.
  3. Prohibited Uses: You agree not to:
    • Use the Bot for any unlawful purposes or in a way that could damage, disable, overburden, or impair the Bot.
    • Attempt to gain unauthorized access to the Bot, its servers, or networks connected to the Bot.
    • Use the Bot to distribute, post, or transmit any harmful, offensive, or illegal content.
    • Resell, sublicense, or otherwise transfer any features or functionality of the Bot to third parties without explicit permission from empdarkness.

Intellectual Property and Use of Assets​

  1. Ownership: All intellectual property rights in the Bot and its content are owned by empdarkness or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Bot for its intended purposes.
  2. Warframe Assets: The Bot utilizes various assets from Warframe, which are owned by Digital Extremes. These assets are used under fair use principles to enhance the Bot's functionality related to Warframe. The inclusion of these assets does not imply any affiliation with or endorsement by Digital Extremes.
  3. Restrictions: You may not:
    • Copy, modify, distribute, or create derivative works based on the Bot or its content.
    • Reverse engineer, decompile, or disassemble any part of the Bot.
    • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

Disclaimers and Limitation of Liability​

  1. No Warranties: The Bot is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Bot will be uninterrupted, error-free, or free of viruses or other harmful components.
  2. Limitation of Liability: To the maximum extent permitted by law, empdarkness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
    • Your use or inability to use the Bot.
    • Any unauthorized access to or use of our servers and/or any personal information stored therein.
    • Any bugs, viruses, trojan horses, or similar issues transmitted through the Bot by any third party.

Indemnification​

You agree to indemnify, defend, and hold harmless empdarkness, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Bot, or your violation of these Terms of Use.

Changes to the Terms​

We may update these Terms of Use from time to time. We will notify you of any changes by posting the new Terms of Use on this page. Your continued use of the Bot after any changes indicates your acceptance of the new Terms of Use.

Governing Law​

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
